  • Use of Personal Information. We may use any Personal Information that we collect:

    • To provide the Services to you;

    • To develop, maintain and analyze our Services;

    • To improve our Services;

    • To develop new programs and services;

    • To comply with legal obligations and legal procedures;

    • To prevent fraud, criminal activity, or misuses of our Services; and

    • For any lawful purpose provided that you offer your consent.

    We may also use Personal Information to communicate with you via email or text message to verify your account, notify you about certain activity on our Services, inform you of changes to our policies and procedures, or to otherwise facilitate the operation of the Services.

    • Aggregate or De-Identified Personal Information: We may de-identify or aggregate your Personal Information so that you are not identified as an individual use such information to analyze the effectiveness of our Services, to improve and add features to our Services, to conduct research and for other similar purposes. We may also provide such de-identified or aggregated Personal Information partners (or allow partners to collect that information from you) to third-parties, including our partners, for business purposes.

    • Business Transfers: If we are involved in strategic transactions, reorganization, bankruptcy, receivership, or transition of service to another provider (collectively, a “Transaction”), your Personal Information and other information may be disclosed in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.

  • Data Security and Storage. Birth By Us has implemented measures designed to protect your Personal Information from loss, unauthorized access, and alteration. We endeavor to protect the privacy of your account and Personal Information we hold in our records and actively work to prevent unauthorized entry or use, hardware or software failure, and other factors that could potentially compromise security of user information.

    The safety and security of your information also depend on you. Certain parts of the Services are protected by a password, and it is your responsibility to keep that password confidential. We will retain your information in line with our legitimate business purposes for as long as your account is active or for as long as needed to provide you with the Services, as long as it is necessary to comply with law or court order, to enforce or apply our Terms of Service [[https://tiny.cc/bbutermsofservice]] and other agreements; or protect the rights, property, or safety of us, our employees, our users or others.

    Unfortunately, the transmission of Personal Information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through our Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

  • Access, Modification and/or Deletion of Personal Information. You may access, and, in some cases, edit or delete your name, password, and phone number through your account settings. The information you can view, update, and delete may change over time.

    You may contact us at the contact information below to request that we delete your account and your Personal Information from the Services. If you choose to delete your account entirely, the Personal Information collected upon user registration will be deleted automatically within 30 days. However, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other users of the Services. Note that if you request removal of your Personal Information, you may no longer be unable to access and/or use the Services.

  • Age of Users. If you are younger than 18, you may not download or use the Services or access or provide any content.

    The Services is not intended for children under 16 years of age, and we do not knowingly collect Personal Information from children under 16. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete such Personal Information.   • Third-Party Links. The Service may contain links to other websites not operated or controlled by us, including social media services. The information that you share with these third-party websites will be governed by the specific privacy policies and terms of service of such third-party website and not by this Policy.   • State Privacy Rights. State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information.

  • The right to know information about our processing of your Personal Information, including the specific pieces of Personal Information that we have collected from you;

  • The right to request deletion of your Personal Information;

  • The right to correct your Personal Information; and

  • The right to be free from discrimination relating to the exercise of any of your privacy rights.

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their Personal Information.

  • Access and delete certain Personal Information.

  • Data portability.

  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their Personal Information, accounting for the Personal

  • Information’s nature and processing purpose.

  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

  • Nevada provides its residents with a limited right to opt-out of certain Personal Information sales. Residents who wish to exercise this sale opt-out rights may submit a request through the contact information below. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

    To the extent applicable under the laws of your state, you can exercise privacy rights described in this section by submitting a request through the contact information below. In order to protect your Personal Information from unauthorized access, change, or deletion, we may require you to verify your credentials before you can submit a request to know, correct, or delete Personal Information. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide additional Personal Information and proof of residency for verification. If we cannot verify your identity, we will not be able to honor your request. You may also submit a rights request through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf and you may also be required to independently verify your identity and submit proof of your residency with us.     Depending on where you live, you may have the right to appeal a decision we make relating to requests to exercise your rights under applicable local law. To appeal a decision, please send your request to the contact information below.

  • Changes to the Policy. We may update this Policy from time to time. If we make material changes to how we treat the Personal Information of our users, we will notify you by email to the primary email address specified in your account, by text message, or through a notice on our home page.
